Use of Service
Arborsist is provided for the purpose of tree management and safety issue reporting. You agree to use the service only for lawful purposes and in accordance with these terms.
Prohibition of False Reports
You agree not to submit false, misleading, or fraudulent reports through the Arborsist system. Submitting false reports wastes resources, diverts attention from genuine safety concerns, and may delay response to actual emergencies. You acknowledge that submitting false reports may result in your access to the service being restricted or terminated.
Content and Data Permission
By submitting reports, photographs, descriptions, or other content through Arborsist, you grant Arborsist permission to store, process, and use this information for the purpose of managing tree safety and maintaining tree inventories. This includes:
- Storing submitted photographs and associating them with tree records
- Storing and processing your email address and contact information
- Storing and processing issue descriptions and safety ratings
- Sharing this information with authorized personnel who need it to address tree safety concerns
You represent and warrant that you have the right to grant these permissions and that your submissions do not infringe upon the rights of any third party.
Content Moderation
Arborsist reserves the right to review, modify, or remove any content submitted through the system that is:
- Abusive, harassing, or threatening
- False, misleading, or fraudulent
- Off-topic or unrelated to tree management
- In violation of these Terms of Service
- In violation of applicable laws or regulations
Arborsist may, at its sole discretion, remove such content and restrict or terminate access to the service for users who violate these terms.
Service Availability
Arborsist strives to provide reliable service, but we do not guarantee that the service will be available at all times or free from errors, interruptions, or technical issues. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ARBORSIST DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARBORSIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
Indemnification
You agree to indemnify and hold harmless Arborsist, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the service, your violation of these Terms of Service, or your violation of any rights of another party.
